Plan, To Be Happy

Over the years, our law practice has seen hundres of people shocked to learn that a Texas Judge my divide their community estate the way the judge feels is “just and right” There is no automatic 50/50 in the Texas. Additionally, the higher earning spouse often recieves less than half.

Do You Need a Prenup or Postnup? Some things to consider!

  • Everything a spouse owns is community property until they prove otherwise, clearly and convincingly. Often this cannot be done. When it can, its expensive.
  • Without a Prenup or Postnup, also known as a marital agreement, “Trial Courts” have wide discretion and are allowed to take many factors into consideration when making a just or right division.  Schleuter v Schleuter, Texas Supreme Court 199

That agreement may characterize property in a manner that is different from what the law would do without such an agreement. Premarital and post-marital agreements are completely enforceable in Texas and favored by Texas law.[/vc_toggle][vc_toggle title=”Are There Endless Options For Texas Marital Agreements?” style=”rounded” color=”green” el_id=”1518123015391-0dc01a7a-9e0f” css=”.vc_custom_1564432657456{margin-left: 50px !important;}”]There is no strict formula that spouses must follow in dividing or characterizing their property. A couple about to marry may choose to designate everything that each acquires during marriage as his or her separate property so no community property is created. They may choose to state that if the marriage ends each will receive 50% of the community property (Texas law does not provide for any automatic division, 50/50 or otherwise). If one spouse has substantially more assets than the other an agreement can provide that the assets will remain separate, but some will be given to the other spouse at various intervals or upon certain events.[/vc_toggle][vc_toggle title=”How Many Types Of Marital Agreements Are Available?” style=”rounded” color=”green” el_id=”1518123461621-a6606f9a-e5f1″ css=”.vc_custom_1564432683122{margin-left: 50px !important;}”]When an agreement is signed before marriage, it is called variously a prenuptial agreement (“prenup”), a premarital agreement, or an antenuptial agreement. When a married couple decides to partition their community estate into two separate estates, that document is referred to as a partition agreement, a post-marital agreement or a postnuptial agreement.[/vc_toggle][vc_toggle title=”Can We Get A Marital Agreement After We Are Married?” style=”rounded” color=”green” el_id=”1518124025584-9456f7a4-a75f” css=”.vc_custom_156443269470{margin-left: 50px !important;}”]A married couple may choose to divide their community estate into two separate estates with a partition agreement. My husband and I had the privilege of being represented by attorney Aaron Wallace who was assisted by paralegal, Janette Gama, in our 2.5 year long custody battle. Aaron was phenomenal in educating us on the Texas Family Laws and kept us informed throughout the entire process. Aaron’s expertise helped guide us on decision-making and court processes. Janette worked diligently to keep all exhibits organized and communicated any updates regarding the case in a timely manner. We were truly blessed to have had such an amazing team who were devoted to upholding justice and fair/equal parenting rights. Most importantly, Aaron persistently presented the children’s best interest to the judge and successfully achieved favor in granting my husband equal parenting time that not only he deserved, but that the children deserved as well. Our family is beyond happy with the outcome of this matter and we are forever grateful for the time and effort that Aaron poured into helping us get to this point. Thank you all so much for everything you all did for our family.

Aaron has helped guide us through one of the most trying and difficult times in my family’s life. Throughout this entire journey Aaron has remained realistic, professional, and has truly cared about our families needs. Aaron was able to help us settle our case in mediation while giving us peace of mind. The professionalism and organization of The McNamara Law Firm was superb! Paralegal J. Gama always held her self in a professional, courteous and educated manner. We are truly grateful for their help and guidance. We will definitely choose Aaron again should we need to seek legal counsel in the future.
